Ride And Tech – Rental Services

This Rental Services Policy explains the responsibilities of users and vehicle providers regarding vehicle damage, loss, accidents, insurance and related rental issues.

Ride And Tech provides a platform to facilitate rental services between users and vehicle providers. The specific rental terms, security deposit, insurance conditions, permitted use and other applicable conditions may vary by vehicle and provider.

1. User Liability

During the rental period, the user is responsible for the vehicle and its included items, subject to the agreed rental terms.

The user may be responsible for:

  • Physical damage caused to the vehicle during the rental period
  • Loss or damage to keys, accessories, documents or other supplied items
  • Traffic violations, penalties and fines arising from the user's use of the vehicle
  • Towing, recovery or impound charges resulting from misuse, unlawful use or violation of the rental terms
  • Damage resulting from negligent, reckless or prohibited use of the vehicle

Where applicable, amounts payable by the user may be recovered from the security deposit or charged separately if the actual cost exceeds the available deposit.

Any damage assessment and recovery should be based on the applicable rental agreement and the circumstances of the incident.

2. Provider Liability

Vehicle providers are responsible for ensuring that their vehicles are appropriately maintained and legally permitted to be used for the relevant rental service.

Providers are responsible for:

  • Maintaining the vehicle in a reasonably safe and roadworthy condition
  • Maintaining valid registration and applicable vehicle documentation
  • Maintaining insurance as required by applicable law and the relevant rental arrangement
  • Disclosing known material vehicle conditions relevant to the rental
  • Not charging users for damage that was documented as pre-existing before the rental

The Motor Vehicles Act contains requirements relating to vehicle registration and third-party insurance.

3. Accidents and Vehicle Damage

If an accident, collision or significant vehicle damage occurs during a rental, the user should:

  • Inform the vehicle provider as soon as reasonably possible
  • Notify Ride And Tech support where the booking was made through the platform
  • Contact the police or other authorities where required
  • Cooperate with the provider and insurer during the claims process
  • Provide accurate information, photographs or other relevant documentation when requested

Users should not admit liability, make unauthorised repairs or settle an insurance matter independently without first informing the relevant provider, except where immediate action is reasonably necessary for safety.

Failure to report an accident or provide required information may affect the handling of an insurance claim or the user's obligations under the applicable rental agreement.

4. Normal Wear and Tear

Normal wear and tear resulting from reasonable use of the vehicle is not intended to be charged to the user.

Examples may include:

  • Ordinary tyre wear
  • Minor deterioration associated with normal use
  • Other reasonable wear consistent with the vehicle's age and condition

Damage caused by misuse, negligence, accidents or prohibited use is treated differently from normal wear and tear.

5. Insurance and Claims

Insurance coverage depends on the vehicle, provider, insurance policy and applicable rental terms.

Users should review the insurance conditions applicable to their booking before using the vehicle.

Depending on the applicable policy and rental agreement:

  • An insurance deductible or excess may be payable by the user
  • Certain types of damage may not be covered
  • Claims may require police documentation or other evidence
  • Illegal, reckless or prohibited use may affect insurance coverage
  • The insurer ultimately determines coverage and claim settlement in accordance with the applicable policy

Third-party motor insurance is a statutory requirement for vehicles used in public places under the Motor Vehicles Act, subject to the Act and applicable rules.

6. Ride And Tech's Role

Ride And Tech may facilitate communication, booking information and support between users and vehicle providers.

However, the vehicle provider remains responsible for the vehicle, its maintenance, documentation, applicable insurance and obligations arising from the rental arrangement.

Ride And Tech may assist users and providers in communicating about an incident or resolving a dispute, but such assistance does not make Ride And Tech the insurer, vehicle owner or final decision-maker regarding an insurance claim or damage assessment.

Nothing in this policy is intended to exclude or restrict any rights or remedies that cannot legally be excluded under applicable law.

7. Dispute Resolution

If a disagreement arises regarding vehicle damage, charges, an accident or an insurance matter, users should first contact the relevant vehicle provider and Ride And Tech support.

Ride And Tech may assist in facilitating communication and reviewing information available through the platform.

Where a dispute cannot be resolved informally, the parties may pursue the remedies available to them under the applicable rental agreement and law.
